carbubly Refund & Payment Dispute Policy

carbubly (“carbubly,” “we,” “us,” or “our”) operates a marketplace that connects customers with independent car wash, detailing, and automotive service providers (“Vendors”) offering promotional deals and services through the carbubly platform.

carbubly is a marketplace and technology platform. Unless expressly stated otherwise, carbubly does not own, operate, manage, or control the independent Vendors that perform the services purchased through carbubly.

This Refund & Payment Dispute Policy (“Policy”) applies to purchases made through carbubly and should be read together with carbubly’s Terms of Service and any terms displayed with the applicable Deal.

By completing a purchase through carbubly, you acknowledge that you have reviewed and agreed to this Policy.

1. All Sales Are Final

Except where expressly provided in this Policy or required by applicable law, all purchases made through carbubly are final and non-refundable once the transaction has been completed.

Customers are responsible for reviewing all Deal information before purchasing, including the Vendor, location, price, services included, vehicle restrictions, exclusions, additional charges, and other applicable terms.

A change of mind, failure to use a Deal, scheduling preference, relocation, purchase of the wrong Deal, or failure to review the Deal terms does not, by itself, entitle a customer to a refund.

Nothing in this Policy limits any non-waivable consumer right or remedy available under applicable law.

2. Buy Today, Redeem Anytime

Unless different terms are clearly disclosed before purchase, eligible carbubly Deals are offered under carbubly's “Buy Today. Redeem Anytime” policy.

An unused Deal may generally be redeemed while the participating Vendor remains active and continues to honor the Deal, subject to the specific terms applicable to the purchase and applicable law.

A Vendor's presence on carbubly at the time of purchase does not guarantee that the Vendor will remain in business or continue participating on carbubly indefinitely.

3. Independent Vendor Responsibility

All car wash, detailing, and related automotive services purchased through carbubly are performed by independent third-party Vendors.

carbubly does not own, operate, manage, supervise, employ, or control a Vendor or its employees, contractors, facilities, equipment, or performance of automotive services.

The Vendor is responsible for performing and fulfilling the service purchased by the customer and for the quality, safety, legality, availability, and performance of that service.

Service-related concerns, including complaints regarding service quality, vehicle treatment, alleged damage, employee conduct, or services performed at a Vendor's location, should be directed to the Vendor.

Nothing in this section excludes or limits responsibility that cannot lawfully be excluded under applicable law.

4. Payment to Vendors

carbubly may facilitate payments between customers and participating Vendors.

Depending upon the applicable payment arrangement, all or a portion of the funds associated with a Deal may be transmitted, settled, or otherwise disbursed to the participating Vendor.

Once funds attributable to a Deal have been paid or disbursed to a Vendor, carbubly may no longer possess or control those funds.

Processing a transaction through carbubly does not make carbubly the provider of the underlying car wash, detailing, or automotive service.

5. Vendor Withdrawal, Termination, Removal or Closure

A Vendor's withdrawal from carbubly, termination or expiration of its relationship with carbubly, suspension or removal from the platform, change of ownership, closure, cessation of operations, or other departure from carbubly does not automatically eliminate obligations relating to Deals sold before that event.

If the Vendor has already received payment attributable to an unused Deal, the Vendor remains responsible for its obligations associated with the Deal and the funds it received, including honoring the Deal or providing any refund required under the applicable Deal terms or applicable law.

Where the Vendor has received and retained the applicable Deal funds, a customer seeking a refund of those funds must contact the Vendor directly.

carbubly may, when reasonably possible, assist the customer by providing available Vendor contact information or communicating with the Vendor. Such assistance does not constitute carbubly's assumption of the Vendor's financial, contractual, or refund obligations.

carbubly is not responsible for issuing a refund from funds that have already been paid to and retained by an independent Vendor, except to the extent carbubly is independently required to do so under applicable law.

A Vendor's departure from carbubly does not automatically entitle a customer to carbubly account credit.

6. Vendor Refusal to Honor a Valid Deal

If an active Vendor refuses to honor an otherwise valid and unused Deal, customers should promptly contact carbubly Support.

Customers may be asked to provide their order information, the Vendor's name, the date redemption was attempted, and a description of what occurred.

carbubly may investigate the matter, contact the Vendor, and take appropriate action concerning the Vendor's continued participation on the platform.

If the Vendor has already received and retained the funds attributable to the Deal, any obligation to refund those funds remains the responsibility of the Vendor, subject to the applicable Deal terms and applicable law.

7. Service & Processing Fees

Any service fee, processing fee, platform fee, or similar fee charged by carbubly in connection with a transaction is separate from the amount charged for the underlying car wash, detailing, or automotive service.

Except where required by applicable law or where carbubly determines that a fee resulted from a duplicate transaction, unauthorized transaction, or payment-processing error, service and processing fees are final and non-refundable once the transaction has been successfully completed.

If a Vendor later withdraws from carbubly, is suspended or removed, closes its business, changes ownership, or becomes unable or unwilling to honor a purchased Deal, any separate service or processing fee retained by carbubly remains non-refundable, except where otherwise required by applicable law.

A Vendor's obligation to honor or refund the underlying Deal does not, by itself, create an obligation for carbubly to refund a separate service or processing fee retained by carbubly.

8. Duplicate, Incorrect or Unauthorized Transactions

The final-sale policy does not prevent a customer from contacting carbubly regarding a suspected:

  • duplicate charge;
  • incorrect transaction amount;
  • unauthorized transaction; or
  • payment-processing error.

Customers should contact carbubly Support promptly after discovering an issue. carbubly may request information reasonably necessary to investigate the transaction.

9. Payment Disputes & Chargebacks

Customers retain any chargeback, payment-dispute, or consumer rights that cannot legally be waived.

Customers may not knowingly initiate fraudulent, false, abusive, or bad-faith payment disputes, including falsely representing an authorized purchase as unauthorized or knowingly providing false information regarding a valid transaction or redemption.

Where permitted by applicable law, customers are encouraged to contact carbubly Support before initiating a payment dispute so carbubly has an opportunity to investigate the issue.

If a payment dispute or chargeback is initiated, carbubly may provide relevant transaction information to the payment processor, issuing bank, card network, or other appropriate party, including purchase records, Deal terms, redemption records, communications, account records, and evidence of acceptance of applicable terms.

carbubly reserves the right to contest invalid, fraudulent, or abusive payment disputes to the fullest extent permitted by applicable law.

10. Fraud and Abuse

To the extent permitted by applicable law, carbubly may suspend, restrict, or terminate accounts reasonably determined to have been used for fraud, repeated abuse of payment disputes, manipulation of Deals or promotions, unauthorized activity, or other material violations of carbubly's Terms of Service.

carbubly will not restrict a customer merely for exercising a lawful, good-faith consumer right.

11. Refunds Required by Law

Nothing in this Policy is intended to waive, restrict, or eliminate any consumer protection or other legal right that cannot lawfully be waived.

If applicable law requires a refund notwithstanding another provision of this Policy, the applicable legal requirement will control.
